Terms of Service

Last Updated: February 2025 • Effective Date: January 1, 2025

Please read these Terms of Service carefully before utilizing BillOfSaleFree. By accessing our website, creating forms, or downloading documents, you agree to be bound by the terms and legal disclaimers outlined below.

Notice: Not Legal Advice / No Attorney-Client Relationship

BillOfSaleFree provides automated, self-service software tools and generalized legal form templates based on statutory guidelines. BillOfSaleFree is not a law firm, does not provide legal advice, and does not substitute for an attorney licensed in your jurisdiction. Utilizing our software does not establish an attorney-client relationship. If you require legal advice or need to resolve specific title encumbrances, lien disputes, or specialized asset transfers, you should consult an attorney.

1. Acceptance of Terms

By utilizing BillOfSaleFree ("the Service"), you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with any provision of these Terms, you must discontinue use of the site immediately.

2. Permitted Use & License

BillOfSaleFree grants you a non-exclusive, non-transferable, royalty-free license to use the service to generate bills of sale for personal or direct business transactions.

You agree not to scrape, reverse engineer, resell, repackage, or systematically mirror the document templates, statutory databases, or underlying code for commercial redistribution as a standalone document service without prior written authorization.

3. Nature of Bill of Sale Documents

A Bill of Sale serves as a legal receipt and record of transfer of personal property between a seller and a buyer. However:

  • Title Transfer Required: In most US states, a bill of sale alone does not constitute legal title. The official certificate of title must be duly endorsed and submitted to the state Department of Motor Vehicles (DMV) or local tax collector.
  • Odometer Compliance: Federal law (49 U.S.C. Chapter 327) and state statutes mandate accurate mileage disclosure on vehicles 20 model years old or newer. Intentional misrepresentation carries civil and criminal penalties.
  • Notary Requirements: Certain states (including Louisiana, Montana, Nebraska, Maryland, West Virginia, and others under specific criteria) require notarization for vehicle or boat title transfers. It is your responsibility to have your document notarized when required by your state.
  • Seller Notice of Sale / Release of Liability: Sellers are responsible for filing a Notice of Transfer and Release of Liability with their state DMV to avoid continuing liability for parking violations, tolls, or infractions.

4. "As-Is" Disclaimers & Warranty Exclusions

The templates provided by BillOfSaleFree default to an "As-Is, Where-Is" condition clause standard for private party transactions. Under this clause, the seller disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, except that the seller warrants lawful ownership and clear title free of undeclared liens. Both parties agree that the buyer has had the opportunity to inspect the vehicle prior to purchase.

5. Disclaimer of Warranties for the Service

The Service, including all templates, text, statutory citations, and output documents, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. While we strive to maintain our 50-state statutory database with the latest DMV forms and codes, laws and municipal administrative requirements change frequently. We do not warrant that the templates will meet every specific local county requirement or that the site will be error-free.

6. Limitation of Liability

To the fullest extent permitted by applicable law, BillOfSaleFree, its owners, operators, and developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, vehicle value, or legal fees, arising out of your use of or inability to use the service, or any document created through the service.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
